I wonder too. It tells me I'm either banned, or un-activated, when I try to change my avatar.

It is not possible to change the avatar as basic user.

Probably they are former premium users, whose status finished. Now they are basic users again - however the Avatar remains valid.
(For rank up to premium have a look at 'Upgrade' on the left menu.)
